1. Scope & Understandability
These Terms of Use govern the use of the mobile app HelloKiwi. By installing or using the app, you agree to them.
We keep our rules deliberately short and easy to understand. Details about data processing can be found in our Privacy Policy. Legal information is provided in the Imprint.
2. What HelloKiwi can do
HelloKiwi helps you plan and organise your trips – clearly and offline-friendly.
- Trip & destination management: Destinations, notes, photos.
- Tasks & events: To-dos per trip, reminders.
- Packing lists: Your own and suggested lists.
- Sharing trips: Share trips with other HelloKiwi users via Apple iCloud / CloudKit and collaborate (optional).
- Optional AI assistance: e.g. when creating packing lists.
Note: Features may evolve with updates – we will inform you about major changes in the app.
3. No account required
You do not need a user account. We do not operate servers for user data. Everything important stays on your device.
4. Permissions – you decide
Depending on how you use the app, it may request access such as:
- Calendar: Create trip and event entries (local; only with consent).
- Camera/Photos: Take or select images (local; no transfer by us).
- Notifications: Reminders for trips, tasks and events (only with consent).
You can revoke permissions at any time in the system settings.
5. Where your data is stored
Your content (e.g. trips, photos, notes) is stored locally in an app database on your device. We perform no uploads to our own servers. When the app is uninstalled, local data is removed.
If you activate the iOS-integrated synchronisation via iCloud / CloudKit, your app data (e.g. trips, destinations, packing lists, settings) can be synchronised between your own devices using the same Apple ID. Synchronisation is handled exclusively via Apple’s iCloud services; we have no access to this content.
6. Cloud backups (optional)
If you use system-level backups (e.g. Apple iCloud), the rules of the respective provider apply. These backups are outside our control.
The iCloud synchronisation of your HelloKiwi data (between your devices) is separate from such system backups and can be enabled or disabled in the iOS settings (iCloud → Apps using iCloud).
7. Optional AI features – clearly explained
If you activate AI features, we process only the content necessary to execute your request. This means:
- No identifiers: We do not transmit names, emails, addresses or similar identifying data.
- Purpose limitation: Content is used solely to technically provide your request.
- No long-term storage: No long-term storage for our own purposes.
- No model training: Your content is not used to train general AI models.

8. External content & links
We may integrate services and content from third parties (e.g. maps, places, booking links). These providers are responsible for their own content. Their terms and privacy rules apply.
If you share trips with others, invitations or sharing links may be provided via Apple iCloud / CloudKit. Apple is responsible for the technical provision of these shares; Apple’s terms of use apply.
Example: Opening hours or ratings may change – always check official sources for reliable information.
9. Time-critical information
Information such as flight times, opening hours or event times may change at short notice. Official information provided by the respective providers is authoritative. We are not liable for any damages arising from the use of such information.
10. Availability & updates
We do our best to keep the app stable – without data selling or tracking. However, uninterrupted availability or complete error-free operation cannot be guaranteed.
Updates may add, improve or remove features. For significant changes, we will notify you in the app.
11. Security & no trackers
HelloKiwi uses no tracking, no advertising IDs and no profile building. Further details can be found in the Privacy Policy.
12. What is not allowed
To keep the app safe for everyone, the following are prohibited, among others:
- reverse engineering, manipulation or bypassing protection mechanisms,
- automated mass access or interference with operation,
- storing, processing or distributing illegal content, including:
- child sexual abuse material (CSAM) or any form of sexual violence,
- pornography that is illegal in your country (e.g. non-consensual, violence-glorifying, bestiality),
- content violating privacy, copyright, trademark or property rights of others,
- extremist, hate-inciting, discriminatory or violence-glorifying content.
Important notes:
- HelloKiwi stores your data exclusively locally on your device and operates no servers for user data. We do not scan your local content and do not actively moderate it.
- You are solely responsible for content you store in or share from the app (e.g. exports/sharing).
- Zero tolerance for CSAM: If we receive legally validated reports of CSAM, we comply with legal obligations and – where required – cooperate with authorities.
- If you share trips with other people, you must ensure that you do not send unlawful, confidential or non-consensually shared content.
13. Liability – fair rules
The use of HelloKiwi is at your own risk. Your statutory consumer rights remain unaffected. We are not liable – where permitted by law – for device malfunctions, data loss, conflicts with external backups or damages outside our control.
We assume no responsibility for services and infrastructure of third parties (particularly Apple iCloud / CloudKit, App Store, operating system, internet connectivity). Outages or restrictions of these services may affect multi-device synchronisation or shared trips.
14. Costs & in-app purchases
The basic version is free. Future additional features may be offered as optional in-app purchases. Prices will be displayed transparently in the app.
15. Intellectual property
Designs, logos, layouts and content of HelloKiwi are protected by copyright. Use outside the app or duplication is only permitted with prior consent.
16. Ending your usage
You may end your usage at any time by uninstalling the app. Local app data stored on your device will be removed.
17. Youth protection
HelloKiwi is intended for users aged 16 and over. Use by minors is the responsibility of their legal guardians.
18. Export restrictions
The app may use cryptographic technologies. Usage may be subject to local export regulations.
19. Changes & notifications
We adapt these terms when services or legal situations change. For major changes we will notify you in the app and, if required, request renewed consent.
20. Applicable law
The material law of the Kingdom of Spain applies. Your mandatory consumer protection rights in your country of residence remain unaffected.
21. Severability clause
If any provision is invalid, the remaining provisions remain effective. The invalid provision will be replaced by a permissible rule that most closely reflects its purpose.
